Protect Yourself From Red Flag Laws

(TheConservativeNews.org) – Imagine you are out with your friends and you’re all discussing your daughter’s new boyfriend. You make the same joke millions of parents have before you about shooting him if he ever hurts your child. A few days later the police knock on your door with a warrant to confiscate your guns. 

It turns out one of your neighbors was at the bar and overhead your joke. They called law enforcement and reported you made a threat. Now you have been red flagged and stripped of your Second Amendment rights.

Seems crazy, right? Sadly, it’s happening in states across America.

Red Flag Laws Explained

A “red flag” law, or Extreme Risk Protection Orders (ERPOs), are temporary orders issued by a judge that allows law enforcement to confiscate a person’s guns if they’ve been deemed a threat to others or themself. Their comments on social media, in public, or in private can be used as a basis to issue the order. 

Further, a judge can issue the order without you even having the opportunity to explain yourself. 

Constitutional Rights Violated

A number of Constitutional rights are violated with red flag laws. Using a person’s speech to strip them of their guns, could violate the First and Second Amendments. 

If they live in a state with a law that allows a judge to sign the order without a hearing first, that also deprives an American of their property without due process of the law which is supposed to be protected by the Fifth and Fourteenth Amendments. 

How to Protect Yourself 

You’re probably wondering how you are going to protect yourself from these laws. The sad reality is everyone could become a victim of the overreaching government if their state passes a red flag law. However, there are a few things you could do to maybe shield yourself.

  • Don’t post inflammatory comments online that someone could misconstrue to label you a threat.
  • Watch what you are joking about in public.
  • Become an activist, or join an organization like the NRA, to fight for your rights at every opportunity. 
  • Establish contacts within the police department and community so that you have people who can vouch for you if need be.

Most importantly, if you want to ensure your freedoms are intact, vote for people who respect the Constitution and support the Second Amendment. These rights are under attack all the time and you need to be able to fight back.
